Ehtrace website's general Terms and conditions of use

ARTICLE 1 : Object

The purpose of these “general conditions of use” is to provide a legal framework for the terms and conditions for making the services of the Ehtrace site available and their use by the “User”.
The general conditions of use must be accepted by any User wishing to access the site. They constitute the contract between the site and the User. Access to the site by the User signifies acceptance of these general conditions of use.
In the event of non-acceptance of the general conditions of use stipulated in this contract, the User must renounce access to the services offered by the site.
Ehtrace reserves the right to unilaterally modify the content of these general conditions of use at any time.

ARTICLE 2 : Legal notice

The Ehtrace site is published by SAS Ehtrace with capital of €645,426 whose head office is located at 11, avenue de Canteranne – Bâtiment Electre – Cité de la Photonique – 33600 PESSAC.
The publication director is Mr. Laurent Riffard.
Ehtrace host site is SAS En Ligne with capital of €214,410 whose head office is located at 8 rue de la ville l’Evêque – 75008 PARIS

ARTICLE 3 : Definitions

The purpose of this clause is to define the essential terms of the contract :

  • User : this term designates any person who uses the site or one of the services offered by the site.
  • User content : this is the data transmitted by the User within the website.
  • Member : the User becomes a member when identified on the site.
  • Credentials and password : those are the necessary informations to identify a User on the website. The username and password allow the User to access services reserved for website's members. The password is confidential.

ARTICLE 4 : services' access

The site allows the User free access to the following services :

  • new articles.

The site is accessible free of charge anywhere to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are their responsibility.
The non-member User does not have access to services reserved for members. To do this, he must identify himself using his username and password.
The site implements all the means at its disposal to ensure quality access to its services. The obligation being of means, the site does not undertake to achieve this result.
Any event due to force majeure resulting in a network or server malfunction does not engage the responsibility of Ehtrace.
Access to the site's services may at any time be subject to interruption, suspension, modification without notice for maintenance or any other case. The User undertakes not to claim any compensation following the interruption, suspension or modification of this contract.

ARTICLE 5 : Intellectual property

Brands, logos, signs and any other content of the site are subject to protection by the Intellectual Property Code and more particularly by copyright.
The User requests prior authorization from the site for any reproduction, publication, copy of the various contents.
The User undertakes to use the contents of the site in a strictly private context. Use of the contents for commercial purposes is strictly prohibited.
Any content posted online by the User is their sole responsibility. The User undertakes not to post content online that could harm the interests of third parties. Any legal action taken by an injured third party against the site will be borne by the User.
User content may be deleted or modified by the site at any time and for any reason. The User does not receive any justification or notification prior to the deletion or modification of User content.

ARTICLE 6 : Personnal data

Informations requested when registering on the site is necessary and mandatory for the creation of the User's account. In particular, the email address may be used by the site for the administration, management and operation of the service.
The site ensures to the user to collects and processes personal information in respect of privacy in accordance with Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms. The site is declared to the CNIL under number [number].
Under articles 39 and 40 of the law dated January 6, 1978, the User has a right of access, rectification, deletion and opposition of his personal data. The User exercises this right via :

ARTICLE 7: Liability and force majeure

The sources of information published on the site are deemed reliable. However, the site reserves the right to not guarantee the reliability of the sources. The information given on the site is purely informative. Thus, the User alone assumes full responsibility for the use of the information and content of this site.
The User ensures that his password is kept secret. Any disclosure of the password, whatever its form, is prohibited.
The User assumes the risks associated with the use of his username and password. The site declines all responsibility.
Any use of the service by the User directly or indirectly resulting in damage must be compensated for the site.
An optimal guarantee of the security and confidentiality of the data transmitted is not ensured by the site. However, the site undertakes to implement all necessary means to best guarantee data security and confidentiality.
The site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

ARTICLE 8: Hypertext links

Numerous outgoing hypertext links are present on the site, however the web pages to which these links lead in no way engage the responsibility of Ehtrace which does not have control of these links.
The User therefore undertakes not to hold the site responsible for the content and resources relating to these outgoing hypertext links.

ARTICLE 9: Contract's evolution

The site reserves the right at any time to modify the clauses stipulated in this contract.

ARTICLE 10 : Duration

The duration of this contract is indefinite. The contract produces its effects with regard to the User from the use of the service.

ARTICLE 11: Applicable law and competent jurisdiction

French legislation applies to this contract. In the event of no amicable resolution of a dispute arising between the parties, only the courts within the jurisdiction of the Bordeaux Court of Appeal have jurisdiction.
